1. Introduction
Welcome to OakMossMeadow ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at oakmossmeadow.sbs (the "Service") operated by OakMossMeadow.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
OakMossMeadow offers luxury yacht charter services, which may include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private functions
- Extended charters
Please note that our services are contingent upon availability and favorable weather conditions. We maintain the right to change or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
When you wish to book a charter, ensure that you:
- Are of 18 years or older
- Submit accurate and full details
- Make the necessary deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your booking becomes official once payment is received and we issue a written confirmation. We reserve the right to refuse our services at our own discretion.
3.3 Availability
Charters are firstly subject to the availability of a vessel and secondly to appropriate weather conditions. Our endeavor is to accommodate your booking preferences to the best of our ability.
4. Payment Terms
4.1 Pricing
All charter fees are expressed in € and include applicable taxes unless stated otherwise. Note that pricing is subject to modification without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the total charter cost required at the time of booking
- Remaining balance: Due 48 hours prior to the charter's departure
- Other charges (if any): Payable at the conclusion of the charter
4.3 Payment Methods
Please note that we accept a range of payment methods including major credit cards, bank transfers, and certified cheques. All payments are processed through secure, encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund minus processing fees
- Between 24-72 hours before departure: 50% of the charter cost will be refunded
- Less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
If our captain deems weather conditions as unsafe, we will propose to either:
- Reschedule your charter to an alternative date at no extra charge
- Issue a full refund when rescheduling is not feasible
5.3 Mechanical Issues
Should there be any mechanical issues with the designated vessel, we will endeavor to supply an adequate replacement. Should this be unachievable, you will receive a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers are obligated to:
- Adhere to all instructions supplied by the crew
- Utilize safety gear as instructed
- Inform the crew of any health conditions that may impede safety
- Remain within designated areas on the vessel
6.2 Prohibited Items
The below items are disallowed on board:
- Glass containers
- Illegal substances
- Weapons of any sort
- Excessive drinks (anything beyond moderate consumption)
- Animals (unless previously authorized)
6.3 Conduct
Passenger behavior should at all times remain courteous. We retain the authority to cease a charter prematurely and without any refund if a passenger’s actions represent a safety concern or interfere with others' enjoyment.
7. Liability and Insurance
7.1 Our Liability
Liability on our part is confined to the total amount paid for your charter. We are not liable for:
- Injuries resulting from your own negligence
- The loss or damage of personal belongings
- Indirect, consequential, or exemplary damages
- Delays that result from weather or events outside our reasonable control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained for all our vessels and operations. Passengers have the responsibility to secure their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our yacht services implies an understanding that boating carries innate risks. You accept responsibility for your safety and well-being while partaking in our services.
8. Modifications and Itinerary Changes
We may adjust itineraries, routes, or schedules because of weather conditions, safety concerns, or other operational necessities. We will always attempt to ensure the alterations provide a comparable experience.
9. Force Majeure
Occurrences beyond our control—such as extreme weather, natural disasters, government regulations, port closures, or mechanical failures—may lead to delays, cancellations, or the necessity to alter plans. We are not accountable for such changes.
10. Privacy and Data Protection
Your privacy is respected as per our Privacy Policy. Engaging with our services constitutes your consent to the collection and usage of personal information as described within our Privacy Policy statement.
11. Intellectual Property
Our website's content, which includes text, graphics, logos, and images, is safeguarded by laws pertaining to copyright and trademarks. Reproducing, distributing, or creating works derived from such content requires our explicit written consent.
12. Governing Law
Applicable laws of Spain will govern these Terms. Any resulting disputes will be resolved within the judicial courts of Barcelona, Spain.
13. Changes to Terms
We reserve the right to alter these Terms at any time. Such alterations will be communicated on our website with a revision of the date. Continued use of our services affirms agreement to the amended terms.
